What is
"Probate"?
Probate is a court procedure by which a will is proved
to be valid or invalid. This generally includes all
matters and proceedings under the probate statutes
pertaining to the administration of estates, guardianships
and other personal and estate matters. These proceedings
involve the appointment or designation of an executor, who
under the supervision of the probate court, collects,
manages, maintains and distributes the assets of an estate
after payment of attorney fees, claims, costs, court fees
and other probate expenses.
Is this kit valid in all
states?
This kit can be used in all states. However, the
probate court forms, which are based on the Uniform
Probate Code, have been adopted only in some states.
Therefore, you will need to obtain a copy of your state
probate statutes and a copy of your state and local court
rules to obtain forms for use in any particular court. The
clerk of your local probate court can tell you how and
where to obtain copies of the appropriate court rules,
statutes and forms.
